Madras High Court Issue Notice against Dual Registration in TNHMC

          CHENNAI. NOV.20: The High Court of Madras issued notice to the Tamil Nadu Homoeopathy Medical council to take action against the President Dr.G.P.Hahnemann and Dr.N.V.Sugathan for re-registering in Tamil Nadu Homoeopathy Medical Council while their registration in Kerala hearing the Writ Petition filed by Dr. R. Gnanasambandam, former president of the council today.

          He stated in his affidavit that Dr.G.P.Hahnemann claims to be qualified to practice Homoeopathy and is presently appointed as the President of the Tamil Nadu Homoeopathy Medical Council. He also represents Tamil Nadu State as Elected Member in the Central Council for Homoeopathy. He was earlier member of the Tamil Nadu Homoeopathy Medical Council for 3 terms. He had studied at Kerala and Registered at Travancore Cochin Medical Council bearing the Registration number 1386 and has subsequently “Re registered” at Tamil Nadu Homoeopathy Medical Council bearing the Registration Number A-48 violating the provisions of Tamil Nadu System of Medicine and Practitioners of Homoeopathy Act 1971 and Central Council for Homoeopathy Act 1973.

          Dr.G.P.Hahnemann is a fulltime practitioner at Tiruparkundram, Madurai District and he never took classes but has made a false claim as professor and states in his bio data as Visiting professor of the Saradha Krishna Homoeopathy Medical College. His qualifications are controversial in reference to the RTI act informations.

          Dr.N.V.Sugathan also registered his name bearing Registration number 4867 at Travancore Cochin Medical Council after his study and re registered with the Tamil Nadu Homoeopathy Medical Council with No. A-578. He is an elected member of the Tamil Nadu Homoeopathy Medical Council for 3 terms consecutively. He is a member of the Central Council for Homoeopathy representing the Dr.M.G.R. Medical University. He has completed his D.H.M.S.(Diploma in Homoeopathic Medicine and Surgery)and registered in both councils at Kerala and Tamil Nadu. He is engaged as teaching faculty at Sarada Krishna Homoeopathy Medical College, Kulasekaram, Kanyakumari District since 1998 without any break. Surprisingly he has persued the degrees BHMS (Bachelor of Homoeopathy Medicine and Surgery) and M.D.(Hom) (Doctor of Medicine) as a regular student without attending the classes in the period 1996 to 2001 for BHMS and 2004 to 2007 for M.D(hom) while he was working in the college. The college had promoted him as Lecturer, Assistant professor and professor The information gathered is that the he had obtained BHMS and M.D. degrees without attending the regular college as he was employed in the Sarada Krishna Homoeopathy Medical College at Kulasekaram in Kanyakumari District. Dr.G.P.Hahnemann and Dr. N.V.Sugathan purposely “Re Registered” in the Tamil Nadu Homoeopathy Medical Council only to obtain nominations and contest elections in the State and Central Council for Homoeopathy.

          The petitioner stated that in this context it is pertinent to refer to the letters dated 04.08.2011 and 06.08.2013 issued by the Central council of Homoeopathy to Registrar of the Tamil Nadu Homoeopathy Medical Council in response to the Government of India letter dated 17.04.2013 to the Homoeopathy Central Council wherein it has been reiterated that registration should not be granted to any homoeopathic practitioner again who is registered with any other State Board/Council of Homoeopathy. It was also indicated in the above said letters that the Sections 15 and 26 of Homoeopathy Central Council Act, 1973
Petitioner stated that thus it is obvious that the Dr. G.P Hahnemann and Dr.N.V.Sugathan registration which is subsisting in the Tamil Nadu Homoeopathy Medical Council is not in accordance with law and requires to be removed by the Registrar of the Tamil Nadu Homoeopathy Medical Council.

          Petitioner stated that I gave a representation dated 16.09.2014 to all the respondents enclosing the necessary documents requesting them to take steps to remove the registration of the Dr.G.P Hahnemann and Dr.N.V.Sugathan from the ‘A’ Class register of the Tamil Nadu Homoeopathy Medical Council. Although all the respondents have received the same there has been no response whatsoever till date. Hence I am constrained to file this writ petition seeking for appropriate relief.

          The petitioner also stated that the Medical Register has not been updated and published till date by the Registrar since it was last published in 1978. As a result the Medical Register contains names of several persons who had expired or ceased to practice. This has given room for several cases of impersonations which has been brought to the notice of all the respondents. This has led to several malpractices in the election to the State and Central Council as the Medical Register is the electoral list for these elections. In fact writ petitions are pending before this Hon’ble Court regarding the election held to the State Council in 2011 in which several serious malpractices have been highlighted. I have filed W.P. No. 24226 of 2014 seeking to update the Medical Register and the same is pending before this Hon’ble Court. Dr. G.P Hahnemann and Dr.N.V.Sugathan who are in the helm of affairs have deliberately not updated the Medical Register to sustain their hold over the elections to the State and Central Council. In fact due to their registration in Kerala both the Dr. G.P Hahnemann and Dr.N.V.Sugathan are not entitled to maintain their registrations in the Tamil Nadu Homoeopathy Medical Council.
